US Judge Mandates Release of Abrego Garcia from Immigration Custody

Courtroom scene

A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement is without legal authority.

"Since his return from wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.

The case stems from a mistaken deportation to El Salvador in March, which the government later acknowledged was an mistake. Following his return to the United States to face alien smuggling charges, he was held in immigration detention.

In her order, the court pointed out that the government lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."

Context of the Case

The court challenge center on disputed claims. Whereas the Trump administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically disputes this claim.

He has also entered a not guilty plea to the smuggling charges, which are part of a separate criminal case in the state of Tennessee.

Conditions of Freedom

The court, who was overseeing his challenge to deportation in a Maryland district court, ruled that he must now adhere to the conditions of his release from jail in Tennessee. This order shifts his supervision to the jurisdiction handling his criminal case.

This ruling represents a notable turn in a complex legal case featuring allegations of wrongful detention and disputed gang affiliations.
